Menu Labeling Public Workshops

Background

The Patient Protection and Affordable Care Act of 2010 (ACA), in part, amended the Food, Drug, and Cosmetics Act to require restaurants and similar retail food establishments that are part of a chain with 20 or more locations doing business under the same name and offering for sale substantially the same menu items to provide calorie and other nutrition information for standard menu items, including food on display and self-service food. Providing accurate, clear, and consistent nutrition information, including the calorie content of foods, in restaurants and similar retail food establishments will make such nutrition information available to consumers in a direct and accessible manner to enable consumers to make informed and healthful dietary choices.

Final regulation implementing Section 4205 of Athe ACA, was issued December 2014, and subsequent draft guidance, was issued September 2015.

A new directive in the fiscal year 2016 Omnibus bill delayed implementation of the compliance date until one (1) year after publication of FDA’s final guidance. FDA published the final guidance on May 5, 2016, and the compliance date is May 5, 2017.

Workshops

Three public workshops will be held to help the regulated industry comply with the requirements of the menu labeling final rule.
There is no cost to attend these workshops, and the sessions will not be webcast.

The workshops will consist of two parts:

On the morning of day one, a general session will be held for all registrants where the FDA will present
information on the requirements of the menu labeling final rule and discuss the final guidance.
The afternoon of day one and all of day two will consist of one-on-one consultation sessions with FDA
subject matter experts for individual companies to discuss their specific questions and concerns.
There will be no additional general session after the consultation sessions, and individuals do not need to stay
after their consultation.

Consultation Session Information

Consultation sessions are limited to 15 minutes to help ensure that enough time is available to accommodate
each company that requests a consultation.
It is recommended that participants prepare their questions in advance due to the limited time available.
Consultation sessions should be limited to two members per company.
Seating and sessions are limited, and registration will be on a first-come, first-served basis.
Individuals may sign up for a consultation session when registering for the workshop.
